* Cole, a WVU employee and Gregory, a full-time WVU student, seek an injunction against the defendants from enforcing BOG Policy 57, a “Tobacco Free Campus” which will become effective July 1. This policy prohibits use of tobacco products on WVU properties or on certain properties not owned or under the control of WVU or the BOG. Students could be expelled and employees terminated for violations of the policy.
